The Company, jobasis.com provides its service to you, and all site-related services, including the content, text, article, graphic, design, image and pictures, subject to your compliance with the Terms and Conditions set forth below. Please read this page carefully. If you do not accept the Terms and Conditions stated here, do not use the web site and service. By using the web site, you are indicating your acceptance to be bound by the Terms of this Agreement. You should visit this page periodically to review the Terms and Conditions, because they are binding on you. The terms "You" and "User" as used herein refer to all individuals and/or entities accessing the web site for any reason.
This Agreement is made between the Company and you, the site visitor and/or registered user ("you"). We reserve the right at any time to:
-Change the terms and conditions of this Agreement;
-Change the web site, including eliminating or discontinuing any content on or feature of the web site, restricting the hours of availability or limiting the amount of use permitted; or
-Change any fees or charges for use of the web site, including instituting new or increased fees or charges for the use of the site or any other site-related services or any feature thereof.
Any changes we make will be effective immediately upon notice, which we may provide by any means including, without limitation, posting on the web site or via electronic mail. Your use of the web site after such notice will be deemed acceptance of such changes. Be sure to review this Agreement periodically to ensure familiarity with the most current version. Upon our request, you agree to sign a non-electronic version of this Agreement.
Specific uses for jobseekers
- User(s) seeking employment on the service ("Jobseeker(s)") agree to keep the Login name and password with care and not to disclose them to any other person. jobseeker is solely responsible for maintaining the confidentiality of and for any (authorized or unauthorized) use of the login name and password. The jobseeker agrees to notify the Company immediately of any unauthorized use of the same.
- Jobseeker shall not post any inaccurate, incomplete or false resume information to the Company.
- All information submitted by the jobseekers to the web site must be legal, decent, non-discriminatory and truthful. The jobseekers are solely responsible for the contents and material which they have submitted to the web site or the Company.
- The Company reserves the right to edit any jobseeker's resume as it sees fit.
- The personal data submitted by the jobseekers will be used for the purpose of assisting the jobseekers to seek for appropriate employment with the employers and recruiter members of the web site or the Company. jobseekers do disclose their personal data to the employers and/or recruiter member of the web site and the Company when they apply for job vacancies or enable their personal resume to be stored in the resume database of the Company, all of these are with the acknowledgement of the jobseekers.
- The resume and personal data submitted by the jobseeker is intended for purpose of providing relevant information to users or advertisers ("employers") in seeking employees.
- Any information submitted by the jobseekers to the web site or the Company shall be subject to the Privacy Statement of the Company.
- Jobseeker accepts that the personal data or information given to the employers is given entirely at his / her own risk. The Company will not be responsible or liable in any case if any employer shall use the jobseekers' personal data for any other use other than for seeking employees.
- Jobseeker may send their resume directly to any employer who advertises on or through the site. Alternatively jobseeker may send their resume to the Company through the site in reply to any job advertisement. In such an event and subject to legal requirements, the jobseekers' resumes will be retained on the web site for a predetermined period notwithstanding the deactivation of the service herein and, unless the jobseeker requests to erase or delete it. Thereafter it will be stored in the Company's database at the jobseeker's own risk.
- If the jobseeker joins the "Talent Matching" and consents to disclose his/her resume to potential employers, then all employers and recruiters who place their advertisement with the Company or who subscribe the service of the Company will have access to his/her resume. The Company will not disclose the information of the jobseeker to those employers and recruiters whose identities cannot be identified unless prior consent has been obtained from jobseeker.
- Under the Personal Data (Privacy) Ordinance, the jobseeker is entitled to access his/her own personal data (subject to prior confirmation of identity) kept with the Company and he/she may edit or amend such personal data at any time. Any request for access or correction can be made by sending the request in writing to the Company. Please refer to the Personal Information Collection Statement and Privacy Statement for details. Further or alternatively, the jobseeker (subject to prior confirmation of identity) may directly edit or amend his/her personal data at any time in the site by himself/herself.
Specific uses for employers
- Upon payment of the service fee to the Company and/or upon other terms and conditions (if any) from time to time prescribed by the Company, the employer will be entitled to use the service to advertise job vacancies for a specific period. Employer will be solely responsible for the contents and materials contained in his / her advertisement(s). The Company reserves the right to edit any advertisement as it sees fit.
- Subject to the conditions or requirements as from time to time stipulated by the Company regarding the access of the jobseekers' information, the employers are entitled to access the jobseekers' database maintained by the Company but agree that all information will only be used for the purpose of seeking potential employees and such information shall not be disclosed to any other parties without the prior consent of the jobseeker concerned.
- The Company reserves the right to change the service fee or institute new charges or fees, as it deems appropriate. In the event that any employer should fail to pay the service fee or any other fees or charges due to the Company, the Company reserves the right to suspend or terminate the employer's advertisement and / or accessing right to the jobseekers' database, without prejudice to all other rights and remedies.
Indemnity
All users agree to indemnify, and hold harmless the Company, its officers, directors, employees and agents from and against any claims, actions, demands, losses or damages arising from or resulting from their use of the Company's web site or their breach of the terms of this Agreement. The Company shall provide prompt notice of any such claim, suit or proceeding to the relevant user.
Termination
You agree that the Company, in its sole discretion, may terminate your registration or use of the web site, delete your postings from the web site, for any reason, including, without limitation, for lack of use or if the Company believes that you have breached any of these Terms and Conditions or laws or if the Company is unable to verify or authenticate any information you submit to the web site.
Governing Law and Jurisdiction
The Company's Terms and Conditions and any dispute or matter arising from or incidental to your use of the web site shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR) and both you and the Company agree to submit to the jurisdiction of the courts of the Hong Kong Special Administrative Region.
